TERMS AND CONDITIONS OF THE ONLINE STORE

§1 General Provisions

  1. These Terms and Conditions define the rules for using the online store available at:

  • the Polish Consumer Rights Act,

  • the Civil Code,

  • Regulation (EU) 2016/679 (GDPR),

  • applicable European Union regulations concerning cosmetic products and distance selling.

  1. These Terms regulate in particular:

  • rules for using the Store,

  • conditions for concluding sales agreements,

  • electronic service provisions,

  • return policy,

  • complaint procedures.


§2 Definitions

  • Store – the online store operated by the Seller.

  • Seller – JUSTROSEMARYECOM LLC.

  • Customer – any natural or legal person placing an order through the Store.

  • Consumer – a natural person acting outside their trade or profession.

  • Product – cosmetic products offered in the Store.

  • Sales Agreement – a distance contract concluded between the Customer and the Seller.


§3 Types and Scope of Electronic Services

The Seller provides the following electronic services free of charge:

  1. browsing the Store’s product assortment,

  2. placing orders electronically,

  3. concluding distance sales agreements,

  4. communication via email contact,

  5. receiving transactional messages regarding orders.

Electronic services are provided for an indefinite period.


§4 Technical Requirements

To use the Store, the Customer must have:

  • a device with Internet access,

  • an up-to-date web browser (Chrome, Safari, Firefox, Edge),

  • an active email account,

  • enabled cookies and JavaScript support.

The Seller shall not be liable for technical issues resulting from failure to meet these requirements.


§5 Prohibition of Illegal Content

  1. Customers are obliged to use the Store in compliance with applicable law.

  2. It is prohibited to provide or transmit content that is:

  • unlawful,

  • infringing third-party rights,

  • harmful or containing malicious software.


§6 Conclusion of the Sales Agreement

  1. Information about Products presented in the Store constitutes an invitation to conclude a contract.

  2. Orders are placed through the order form available on the Store’s website.

  3. The Sales Agreement is concluded when the Seller confirms the order electronically.

  4. The Customer is responsible for providing accurate and truthful data.


§7 Payments

  1. Payments are processed via electronic payment providers
    Order processing begins after payment confirmation is received.


§8 Delivery

  1. Products are delivered to the address provided by the Customer.

  2. Delivery costs and available shipping methods are presented during checkout.

  3. Estimated delivery time is indicated on the product page.


§9 Right of Withdrawal (Returns Policy)

  1. A Consumer has the right to withdraw from the Sales Agreement within 14 days without providing any reason.

  2. The withdrawal period expires 14 days after receiving the Product.

  3. To exercise the right of withdrawal, the Customer must send a statement via email to:

  1. The right of withdrawal does not apply to:

  • sealed cosmetic products which were unsealed after delivery due to health protection or hygiene reasons, in accordance with Article 38(5) of the Polish Consumer Rights Act.

  1. Refunds will be processed within 14 days after receiving the returned product.


§10 Complaints Procedure

  1. The Seller is liable for product conformity in accordance with applicable consumer protection laws.

  2. Complaints should be submitted via email to:

  1. A complaint should include:

  • Customer name,

  • order number,

  • description of the issue.

  1. Complaints will be reviewed within 14 days from receipt.


§11 Termination of Electronic Service Agreements

  1. The Customer may stop using electronic services at any time.

  2. The Seller may terminate electronic services if the Customer violates these Terms.


§12 Personal Data Protection

  1. Personal data is processed in accordance with GDPR.

  2. The Seller acts as the Data Controller.

  3. Personal data is processed solely for order fulfillment, customer service, and legal obligations.

  4. Detailed information is provided in the Privacy Policy available on the Store’s website.


§13 Final Provisions

  1. These Terms and Conditions are governed by Polish law with respect to Consumers residing in Poland.

  2. Any disputes shall be resolved by competent courts in accordance with applicable consumer protection regulations.

  3. The Seller reserves the right to amend these Terms for legal or organizational reasons.

  4. The current version of the Terms is always available on the Store’s website.
